Deadline for the PCT national phase entry in Sri Lanka
In Sri Lanka, the deadline for the PCT national stage entry is 30 months from the date of priority. The restoration of this term is impossible.
Minimum of filing documents in Sri Lanka
In Sri Lanka, it is important to provide the National IPO of Sri Lanka with the address and name of the inventor and the applicant, description of the patent, set of claims and payment of the filing fee, assignment deed (if applicable).
Language of the Sri Lankan patent application
In Sri Lankan, the language of a patent application in English. The application may be filed in another foreign language; nevertheless, the English translation should be submitted within 90 days from the date of its filing.
Power of Attorney requirements
In Sri Lankan patent office, a signed and stamped POA must be provided within 90 days from entering the PCT national phase entry.
Assignment Deed
In Sri Lanka, If the applicant is not the inventor, an assignment deed signed and stamped by both parties must be provided within 90 days from the PCT national phase entry.
Search report
In Sri Lanka, an international type search report issued by any International Searching Authority according to the PCT, must be submitted within 90 days from issuance thereof in English.
Grant and maintenance fees
In Sri Lanka, there is no official grant fee needs to be paid. The first annual fees fall due within 2 years after the certificate has been issued. All subsequent annual fees should be paid annually before its anniversary. Late payment is possible within 6 months after alongside payment of the corresponding surcharge. Annual maintenance fees may be paid in advance.
Grace period
In Sri Lanka, there is a 1-year novelty grace period for the disclosures made by the predecessor or the applicant. The disclosure was made in abuse of the rights of the predecessor or the applicant then a six-month novelty grace period is applied.
Representation by a patent attorney
In Sri Lanka, for foreign applicants, it is necessary to perform the PCT national phase entry through a registered patent attorney.
