Term for filing the Estonian industrial design applications
The deadline for filing the Estonian industrial design application claiming priority is six months from the priority date. Extension or restoration is not stipulated.
Minimum industrial design application filing documents in Estonia
To obtain a filing date, it is necessary to provide the Estonian Patent Office with a request to grant a patent on the industrial design, representation of the industrial design, name of the applicant, and the address for correspondence.
Multiple industrial design application in Estonia
It is possible to file a request to register several industrial designs (a multiple design application) if the designs concern the same object, relate to the same class of the Locarno Classification, and are designed in the same manner.
Requirements to the Power of Attorney in Estonia
The Power of Attorney is not required to obtain the filing date, however, it may be requested by the Patent Office at any stage of the application’s processing. The legalization or notarisation of the Power of Attorney is not required.
Priority document for application
If priority is claimed, a certified сopy of the priority document must be provided within nine months from the priority date.
Analysis of an industrial design application in Estonia
The Estonian Patent Office examines the industrial design applications according to formal requirements only.
Novelty grace period for application
Novelty grace period constitutes 12 months from disclosure of the information on the industrial design before the filing of the application or priority date thereof. Disclosure does not disprove the novelty of the design if it was made by the applicant or a third party that directly or indirectly obtained the information about the design from him, against or according to his will.
Grant, validity term, and renewal for design application
The state grant fee is not stipulated. The maintenance fee for a first 5-year period of a design patent validity is included in the official filing fee. The registration may be renewed every five years up to a total term of 25 years from the filing date of the application. A request for renewal should be filed within six months before the date of expiry of the registration or, if an additional state fee is paid, within six months from the date of expiry of the registration together with the corresponding request for restoration.
Representation by an Estonian patent attorney
Representation of legal or natural persons that do not reside in Estonia by an agent, Estonian patent attorney, is required to perform acts for the legal prosecution and protection of industrial designs.
What can be registered as an Estonian industrial design application
Form, shape, configuration, ornamentation, colors, texture, and material of the product (separately or in combination).
