The term for a filing industrial design application in the Czech Republic
The term for filing the design application in the Czech Republic is six months from the priority date. There are no restoration provisions for filing the design application after this term saving the priority right.
Minimum industrial design application filing requirements in the Czech Republic
The filing documents for industrial design applications in the Czech Republic should contain at least:
– application form – dated and signed by the applicant, containing applicant’s name and address;
– image of each design.
Multiple industrial design applications
Multiple design applications may be filed under the condition that all the included designs come under a single class of the International Classification for Industrial Designs (the Locarno Classification).
Power of Attorney requirements in the Czech Republic
Legalization or notarization of the Power of Attorney is not required. It must be submitted to the Czech industrial property office upon filing or within 2 months from the date of receipt of an invitation to file the POA. A scanned copy of the signed and dated POA is sufficient, but the original may be requested at any stage of the proceedings.
Priority document for design application
Priority documents should be provided simultaneously with the design application or within a deadline given by the PTO. Translation of the priority document is not required in the Czech Republic but can be requested by the PTO.
Analysis of a design application in the Czech Republic
Industrial design applications in the Czech Republic are subject to substantive examination. It is requested at the time of filing without a separate request.
Novelty grace period of application
The Novelty grace period provided for design applications in the Czech Republic constitutes 12 months before the filing date or priority date if any.
Grant, validity term, and design renewal for application
The official fees for a grant as well as for the first 5-year validity term are included in the official fee for filing. The validity term of an industrial design in the Czech Republic is five years from the filing date, extendable up to 4 times (25 years in total). For further renewal, the registration holder must file a request for renewal during the last year of each five-year protection period.
Representation by a Czech patent attorney
For foreigners, it is necessary to perform industrial design prosecution in the Czech Republic through an agent, registered as a Czech patent attorney.
