Term for filing an Armenian patent application


The term for filing a patent application in Armenia claiming priority is 12 months from the priority date. The right of priority may be reestablished by the filing of a corresponding request within 2 months after the expiration of the 12-month term.

Patent Filing Requirements in Armenia


The official language for proceedings before the Armenian Patent Office is Armenian. Foreign applicants may submit a patent application in any other foreign language; however, the Armenian translation of the application should be submitted within 3 months from the date of filing.

To obtain the patent filing date, it is necessary to provide the Patent Office with:

  • a request to grant a patent
  • information on the applicant(s);
  • a description of the invention (even if it complies with formal requirements only).

A certified copy of the Priority Document should be submitted within 3 months from the filing date.

The Power of Attorney must be submitted to the Patent Office in Armenia on filing or within 3 months from receiving the corresponding notification from the Patent Office. Legalization or notarisation of the POA is not required.

Analysis of a patent application in Armenia


Formal examination of an application is conducted within 3 months from the filing date. Substantive examination is not stipulated, therefore, preliminary patents are granted at the applicant’s liability based on the formal examination. Within 9 years from the Armenian filing date, it is necessary to submit substantive examination results carried out by a patent organization having the status of an international preliminary examination body or another authorized agency to obtain a patent for 20 years. If the results are not submitted, patent validity is restricted to 10 years from the filing date instead of 20.

Novelty grace period of invention


If the information was disclosed by the candidate (inventor) or any person having obtained the information from the candidate (inventor) within 12 months before the filing or priority date, such disclosure does not disprove the novelty of the invention.

Grant, validity term, and maintenance fees of patent application


The official fees for grant and publication should be paid within 3 months from receipt of the decision to grant a patent. Annual maintenance charges are payable in advance for the next validity year. They are due from the second year of validity. The due date is the anniversary of the filing date. Late payment may be made within the grace period of six months if 50% of the annual fee is paid as a surcharge. The maximum validity period constitutes 20 years from the filing date.

Duration of the patent registration procedure in Armenia


If the prosecution process goes smoothly, it takes approximately 1-2 years to obtain a patent in Armenia.

Utility Model in Armenia


Utility model protection is available under the Armenian legislation. It must be new, unobvious, & industrially applicable. Methods may be protected as utility models. The validity term of a utility model in Armenia is 10 years from the filing date. The procedure of obtaining utility model protection takes approximately 1-2 years.

Representation by an Armenian patent attorney


For foreign applicants, it is recommended to perform patent prosecution through an agent, a registered Armenian patent attorney. However, foreign applicants must provide the Patent Office with the Armenian address for correspondence.
