Deadline for the PCT national phase entry in Poland

The deadline for the PCT national phase in Poland is 30 months from the date of priority. The restoration of this term is impossible.

Minimum requirements for filing

A patent application in Poland must contain 

  • description of the invention 
  • a patent claims.

Language of the Polish patent application

Polish is the official language of the Polish patent application. If the patent application is filed in any other foreign language, the Polish translation thereof must be filed within 90 days from entering the national phase.

Power of Attorney requirements

Official legalization is not required. The POA may be submitted within 2 months from entering the national phase.

Assignment Deed

In case the inventor differs from the application of the Polish patent application, the Assignment Deed shall be provided to the Patent Office within 2 months after the office action invitation.

Substantive examination request

In Poland, the substantive examination of a Polish patent application starts automatically.

Grace period

In Poland, according to the amended Law as of December 1, 2015, the novelty grace period in Poland constitutes 6 months preceding the filing date, on condition that disclosure was prejudicial and was made by a 3rd party.

Grant and patent maintenance

In Poland, within three months from issuance of the Notice of Allowance, the official grant fee, patent publication fee as well as the 1st annuities shall be paid.

Representation by a patent attorney

In Poland, foreigners residing outside Poland must perform the PCT national phase entry in Poland through an agent, a registered Polish patent attorney.
