Deadline for the PCT national phase entry in Saudi Arabia
In Suadi Arabia, the term for entering PCT national phase is 30 months from the priority date. Restoration of this term is not possible.
Filing requirements in Saudi Arabia
Upon entering Saudi Arabia’s national phase entry, it is advisable to submit the Arabic and English translation of the document. It is not possible to present the conversion at a later stage.
For entry into the Saudi PCT national phase, an application must contain:
– name and address of the applicant(s) and/or inventor(s
– a copy of the specification
– a copy of the International Publication
– a copy of the International Search Report;
– a copy of the PCT request (claims, drawings and abstract in Arabic and English)
– priority data, if any.
In Saudi Arabia, you shall submit a certified copy of the Priority Document within 90 days from the PCT national phase entry.
The original of a notarized POA legalized up to the Saudi Consulate may be filed within 90 days from the date of its registration in Saudi Arabia.
If the Saudi PCT national phase application is registered by a person other than the inventor, a legalized Assignment Deed between the applicant and the inventor must be submitted within 90 days from the national phase entry date.
Examination of a PCT national phase patent application in Saudi Arabia
The PCT applications in Saudi Arabia are examined as to compliance with formal requirements. Upon completion of the formal examination, it is published. The fee for substantive examination depends on the complexity of the application. Once the fee is paid within three months, a substantive examination will be conducted.
Novelty grace period
Disclosure will be disregarded if it occurred:
– within 12 months before the registration or priority date (if any) and happened at an officially recognized international exhibition in one of the PCT countries.
– six months before registration of the application in Saudi Arabia or priority date (if any) and resulted from the abusive acts against the applicant.
Grant, validity term and maintenance fees
In Saudi Arabia, the patents are valid for 20 years from the filing date. One can pay the grant fee together with the publication fee. It can be paid within 90 days of the notification from the patent office. Annual maintenance fee shall be paid from January 1 to March 31 of each year. Late payment is possible within three months after the due date. No surcharge will be included, but a further grace period of three months will lead you to pay double the fee.
Duration of the registration procedure
In Saudi Arabia, to obtain a patent, it takes an average of 3-5 years from the national phase entry.
Utility Model
In Saudi Arabia, it is not possible to enter the national phase as a utility model.
