A term for filing a patent application in Saudi Arabia

In Saudi Arabia, a patent filing claiming conventional priority shall be filed with the Patent Office within 12 months from the priority date. Restoration of this term is not possible.

Filing requirements in Saudi Arabia

In Saudi Arabia, You are suppose to submit the English and Arabic translations of the patent application at the time of its filing. You can not submit the translation at a later stage.

To obtain a filing date, it is essential to provide the Saudi Patent Office with:

– payment of the filing fees

– a request to grant a patent;

– an application for a patent containing inventor’s and applicant’s information and addresses;

– patent specification (description, claims,drawings,abstract);

– priority data, if any;

You shall submit a certified copy of the Priority Document within 90 days from the filing date.

The original of a notarized POA legalized up to the Saudi Consulate may be filed within 90 days from registration of a patent application in Saudi Arabia.

If the application is registered by a person other than the inventor, then a notarized and legalized Assignment Deed between the inventor and the applicant must be submitted within 90 days from the filing date.

Examination of a Saudi patent application

The PCT applications in Saudi Arabia are examined as to compliance with formal requirements. Upon completion of the formal examination, it is published. The fee for substantive examination depends on the complexity of the application. Once the fee is paid within three months, a substantive examination will be conducted.

Novelty grace period

Disclosure will be disregarded if it occurred:

– within 12 months before the registration or priority date (if any) and happened at an officially recognized international exhibition in one of the PCT countries.

– six months before registration of the application in Saudi Arabia or priority date (if any) and resulted from the abusive acts against the applicant.

Grant, validity term and maintenance fees

In Saudi Arabia, the patents are valid for 20 years from the filing date. You can pay the grant fee together with the publication fee. You can also pay it within 90 days of the notification from the patent office. The time to pay the Annual maintenance fee is from January 1 to March 31 of each year. Late payment is possible within 3 months after the due date. There is no surcharge for this but a further grace period of three months will lead you to pay double the fee.

Duration of the registration procedure

In Saudi Arabia, to obtain a patent takes an average of 3-5 years from the filing.

Utility Model

Utility model protection is not possible by the IP legislation in Saudi Arabia.
